WILDLIFE (JOINT AUTHORITY) AMENDMENT REGULATION

on March 26, 2025 pursuant to section 104 of the Wildlife Act jointly with a
corresponding order made by the Minister of Environment and Protected Areas (M.O.
6/2025) on March 18, 2025 pursuant to sections 12 and 103 of the Wildlife Act.
1 The Wildlife Regulation (AR 143/97) is amended by this
Regulation.
2 The following is added after section 51:
Allocated licences
51.1(1) An outfitter to whom an applicable licence allocation has
been issued under section 54 or 54.00001, or transferred under
section 55, may purchase on behalf of a resident, non-resident or
non-resident alien an allocated licence available under the outfitter's
allocation.
(2) A resident, non-resident or non-resident alien hunting under the
authority of an allocated licence must be accompanied by a
designated guide while hunting in accordance with the Act and this
Regulation.
3 Section 53(1) is repealed and the following is
substituted:
Designated guide authorization - entitlements
53(1) Subject to this section, the big game guide's designation
referred to in section 52(1)(a) authorizes the designated guide who
holds it, at any one time, to guide for gain or reward,
(a) under a contract referred to in section 58(1)(a) or 59(1)(a), up
to 3 non-resident or non-resident alien licence holders, in any
combination, while the licence holders are hunting wolf,
coyote or big game that the licence holders are legally
authorized to hunt, or
(b) any number of resident licence holders while the licence
holders are hunting any animal that the licence holders are
legally authorized to hunt.
4 Section 69 is amended
(a) in subsection (3) by striking out "(2) (a) or (b)" and
substituting "(2)(a)";
(b) by adding the following after subsection (3):
(4) Instead of exporting the animals referred to in subsection
(2)(b), the import permit also authorizes its holder to traffic in
them with a holder of a zoo permit issued in Alberta.
5 Section 96 is amended
(a) in clause (a)
(i) in subclause (i) by adding ", excluding endangered
bats," after "endangered animals";
(ii) by adding "and" at the end of subclause (i.1),
striking out "and" at the end of subclause (ii)
and repealing clause (iii);
(b) by adding the following after clause (a.2):
(a.3) to the dens of bats used as birthing roosts throughout
Alberta from June 1 to August 31,
6 Section 112(2) is repealed and the following is
substituted:
(2) For the purposes of section 42(1) of the Act, a client may hunt
wolf, coyote or big game unaccompanied by another person referred
to in that subsection if
(a) the client was accompanied by such a person earlier in the
same day,
(b) such a person can locate the client at all times after the two
have parted company, and
(c) the client is again accompanied by such a person later in the
same day.
7 Section 113(1) is repealed and the following is
substituted:
Guiding
113(1) A big game designated guide shall not, at any one time,
guide more than 3 non-resident or non-resident alien licence holders,
in any combination, while hunting wolf, coyote or big game.
8 Section 135 is amended
(a) in subsection (1) by striking out ", a skunk or a bat"
and substituting "or skunk";
(b) in subsection (2) by striking out ", skunk or bat" and
substituting "or skunk".
9 The following is added after section 135:
Possession of bats
135.1 A person may temporarily possess a live bat that is a
non-game animal for the purpose of capturing it and relocating it
from that person's property.
10 Section 153.4 is repealed.
11 Schedule 1, section 16(1) is amended by striking out
"or" at the end of clause (a), adding "or" at the end of clause
(b) and adding the following after clause (b):
(c) a bat that is a non-game animal that is possessed in
accordance with section 135.1 of this Regulation,
