Amendment to O. Reg 386/99 to Enable Delivery of Home Care by Children's Hospital of Eastern Ontario

Summary of Proposal:
The Ministry of Health is proposing to amend O. Reg 386/99 under the Home Care and Community Services Act, 1994 (HCCSA) to facilitate the Children's Hospital of Eastern Ontario (CHEO) delivery of home care services to children and youth in the Champlain region as part of their innovative Kids Come First model, under the same framework that applies to Home and Community Care Support Services. Currently, children and youth receive their home care services from Home and Community Care Support Services: Champlain, also known as the Champlain Local Health Integration Network. The proposed amendment would ensure continuity of care and a smooth transition for clients and families such as:

Extending the same authority of a Home and Community Care Support Services organization to exceed the service maximums for personal support and homemaking services in extraordinary circumstances, on the same conditions, to CHEO. CHEO would then be able to provide the same service levels for clients that they were receiving when they were clients of the Home and Community Care Support Services organization;
Exempting Home and Community Care Support Services: Champlain from s. 22 of HCCSA that would otherwise obligate it to assess need, determine eligibility, and develop a plan of service for eligible children and youth.
Prescribing the types of services that the Minister can approve an agency to provide as part of the Family Managed Home Care Program to facilitate the transfer of arrangements under the Family Managed Home Care program to CHEO.

Analysis of Regulatory Impact:
There are no new administrative costs associated with this regulation amendment. The proposed amendment maintains the requirements to which Home and Community Care Support Services organizations are subject in delivering home care and enables CHEO to provide services to children and youth within that same framework. CHEO is familiar with the delivery of home care services, including the reporting requirements for an approved agency to submit information to the Ministry of Health.
