SPECIAL IMPORT MEASURES ACT

Concrete reinforcing bar — Decision

On June 2, 2021, pursuant to paragraph 41(1)(b) of the Special Import Measures Act, the Canada Border Services Agency (CBSA) made a final determination of dumping concerning certain concrete reinforcing bar originating in or exported from Oman and Russia.

During the period of investigation, subject goods were normally classified under the following tariff classification numbers:

  • 7213.10.00.00
  • 7214.20.00.00

In some instances, imports of subject goods may also have been classified under the following tariff classification numbers:

  • 7215.90.00.90
  • 7227.90.00.90

As of February 4, 2021, the subject goods are usually imported under the following tariff classification numbers:

  • 7213.10.00.11
  • 7213.10.00.12
  • 7213.10.00.13
  • 7213.10.00.90
  • 7214.20.00.00
  • 7215.90.00.20
  • 7215.90.00.30
  • 7227.90.00.50

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the domestic industry is continuing and it will issue its finding by July 2, 2021. Provisional duty will continue to be imposed on the subject goods from Oman and Russia, until the CITT renders its finding.

If the CITT finds that the dumping has caused injury or is threatening to cause injury, anti-dumping duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duty.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

Information

The Statement of Reasons regarding this decision will be issued within 15 days following the decision and will be available on the CBSA website.

FINDING

Concrete reinforcing bar

Notice is hereby given that, on June 4, 2021, further to the Canadian International Trade Tribunal's inquiry, and following the issuance by the President of the Canada Border Services Agency of a final determination dated May 5, 2021, that the above-mentioned goods have been dumped, the Tribunal found (Inquiry No. NQ-2020-004), pursuant to subsection 43(1) of the Special Import Measures Act, that the dumping of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 mm, in various finishes, excluding plain round bar and fabricated rebar products, originating in or exported from the People's Democratic Republic of Algeria, the Arab Republic of Egypt, the Republic of Indonesia, the Italian Republic, Malaysia, the Republic of Singapore and the Socialist Republic of Vietnam, has caused injury to the domestic industry. The product definition also excludes “10 mm diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) that is coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 foot (30.48 cm) up to and including 8 feet (243.84 cm)”.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2021-009) from Inventa Sales & Promotions (Inventa) of Vancouver, British Columbia, concerning a procurement (Solicitation No. K1A30-210980/A) made by the Department of Public Works and Government Services on behalf of Department of the Environment. The solicitation was for virtual event management services related to the World Circular Economy Forum 2021. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on May 28, 2021, to conduct an inquiry into the complaint.

(Leistritz) of Somerville, New Jersey, United States of America, concerning a procurement (Solicitation No. 31026-217733/A) made by Public Works and Government Services Canada on behalf of the National Research Council of Canada. The solicitation was for the supply, transportation, delivery, installation and commissioning of a high free volume twin-screw extruder and all accessories. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on April 16, 2021, to conduct an inquiry into the complaint.
