IRRIGATION DISTRICTS AMENDMENT ACT, 2021

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows:

Amends RSA 2000 cI-11 1 The Irrigation Districts Act is amended by this Act.

2 The following is added after section 7:

Commercial activity — exemption 7.1 No activity carried out for the primary purposes set out in section 6(1)(c) is considered to be a commercial activity.

3 Section 176(2) is amended

(a) in clause (c) by adding “or the exemption to hold a plebiscite” after “generally”;

(b) by adding the following after clause (c):

(c.1) specifying activities that are considered to be commercial activities for the purposes of section 7;

(c.2) exempting activities from being commercial activities for the purposes of section 7;

4 Section 177(2) is amended by adding the following after clause (s):

1 Amends chapter I-11 of the Revised Statutes of Alberta 2000.

2 Commercial activity — exemption.

3 Section 176(2) presently reads in part:

(2) The Minister may make regulations

(c) respecting the conduct and holding of a plebiscite generally;

4 Section 177(2) presently reads in part:

(2) A district may make bylaws

(t) specifying the maximum number of consecutive terms or consecutive years a director may hold office.

2 Explanatory Notes

(s) governing the duties and powers of the manager of the district.
