The Secretary of State makes these Regulations in exercise of the powers conferred by regulations 22 and 24(2) of the Ecodesign for Energy-Related Products Regulations 2010(1) (“the 2010 Regulations”) and Articles 11 and 11A(3) of Regulation (EU) 2017/1369 of the European Parliament and of the Council of 4 July 2017 setting a framework for energy labelling and repealing Directive 2010/30/EU(2) (“the Framework Regulation”).

A draft of this instrument was laid before Parliament in accordance with regulation 24(1)(b) of the 2010 Regulations and Article 11A(2)(b) of the Framework Regulation, and approved by a resolution of each House of Parliament.

For the purposes of regulation 22(1) of the 2010 Regulations, the Secretary of State considers that the requirements set out in regulation 22(2) and (6) are satisfied. The Secretary of State has complied with regulation 22(4) of those Regulations.

For the purposes of Article 11(1) of the Framework Regulation, the Secretary of State considers that the conditions set out in Article 11(1)(a) to (d) are satisfied. The Secretary of State has complied with Article 11(2) of that Regulation.

PART 1INTRODUCTION

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Ecodesign for Energy-Related Products and Energy Information (Amendment) Regulations 2021.

(2) Subject to paragraphs (3) and (4), these Regulations come into force on 1st October 2021.

(3) Regulation 6(6)(a)(iv) comes into force on 1st March 2022 in so far as it inserts the row beginning “Light source parameters” and the two rows after it into Table 6 of Annex 5 to Commission Delegated Regulation (EU) 2019/2016.

(4) Regulation 8(2)(b) comes into force on 1st January 2022 in so far as it amends the entry relating to a solid fuel local space heater in the table in paragraph 4 of Schedule 1 to the Ecodesign for Energy-Related Products Regulations 2010(3).

(5) These Regulations extend to England and Wales, and Scotland.

Interpretation

2.  In regulations 1 and 6, “Commission Delegated Regulation (EU) 2019/2016” means Commission Delegated Regulation (EU) 2019/2016 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of refrigerating appliances and repealing Commission Delegated Regulation (EU) No 1060/2010(4), as modified by Schedule 3 to the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020(5).

PART 2AMENDMENTS TO COMMISSION REGULATION (EU) 2019/424 RELATED TO ECODESIGN

Amendments to Commission Regulation (EU) 2019/424: servers and data storage products

3.—(1) Commission Regulation (EU) 2019/424 of 15 March 2019 laying down eco-design requirements for servers and data storage products pursuant to Directive 2009/125/EC of the European Parliament and of the Council and amending Commission Regulation (EU) No 617/2013(6) is amended as follows.

(2) In Article 4(2) (conformity assessment), for the words after “shall contain” substitute—

(a)the information set out in point 3.4 of Annex 2; and

(b)the details and results of the calculations carried out in accordance with—

(i)where applicable, point 2 of Annex 2; and

(ii)Annex 3 (measurements and calculations)..

(3) In Article 6 (circumvention)—

(a)for “manufacturer or importer” substitute “manufacturer, importer or authorised representative(7)”;

(b)after “the parameters” omit “declared by the manufacturer or importer”.

(4) After Article 7 (indicative benchmarks), insert—

Article 8Review

1.  The Secretary of State must, before 25th December 2024—

(a)evaluate this Regulation, taking into account the speed of technological progress; and

(b)publish a report stating whether or not in their opinion this Regulation should be amended.

2.  If the Secretary of State concludes under paragraph (1) that this Regulation should not be amended, the Secretary of State must review this conclusion from time to time and publish a new report under paragraph (1)(b) at intervals not exceeding 5 years..

(5) In Annex 1 (definitions applicable to Annexes 2 to 5)—

(a)in point (3) (definition of ‘motherboard’), for “the server” substitute “a server or a data storage product”;

(b)in point (4) (definition of ‘processor’), after “a server” insert “or a data storage product”;

(c)in point (5) (definition of ‘memory’), after “a server” insert “or a data storage product”;

(d)after point (35) insert—

(36) ‘declared values’ means the values provided by the manufacturer, importer or authorised representative in the technical documentation in accordance with point 3.4 of Annex 2, for the verification of conformity by the market surveillance authority(8)..

(6) In Annex 4 (verification procedure for market surveillance purposes)—

(a)for the first paragraph substitute—

The verification tolerances set out in this Annex relate only to the verification by the market surveillance authority of the declared values.

The manufacturer, importer or authorised representative of a product must not use the verification tolerances—

(a)to establish the declared values;

(b)to interpret the declared values; or

(c)to communicate better performance..

(b)in point 2—

(i)in point (a), for “values given in the technical documentation pursuant to paragraph 1(2)(b) of Part 1 of Schedule 1A to the 2010 Regulations,” substitute “declared values”;

(ii)after point (c) insert—

; and

(d)the manufacturer, importer or authorised representative has complied with the information requirements in point 3.1 of Annex 2 (servers) or, as the case may be, point 3.2 of Annex 2 (data storage products); and

(e)when the market surveillance authority checks the unit of the model, the unit complies with the resource efficiency requirements in point 3.3 of Annex 2.;

(c)in point 3, for “points 2(a) or 2(b)” substitute “point (2)(a), (b), (d) or (e)”;

(d)in point 4(b), after “manufacturer” insert “, importer or authorised representative”;

(e)in point 5, for “these three units” substitute “the units selected in accordance with point 4(b)”;

PART 3AMENDMENTS TO COMMISION DELEGATED REGULATIONS RELATED TO ENERGY LABELLING

Amendments to Commission Delegated Regulation (EU) 2019/2013: electronic displays

4.—(1) Commission Delegated Regulation (EU) 2019/2013 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of electronic displays and repealing Commission Delegated Regulation (EU) No 1062/2010(9), as modified by Schedule 1 to the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020, is amended as follows.

(2) In Article 1(2) (subject matter and scope), in point (g), for “of products covered by implementing measures adopted under the Ecodesign for Energy-Related Products Regulations 2010” substitute “within the meaning given by regulation 2(1) of the Ecodesign for Energy-Related Products Regulations 2010”.

(3) In Article 2 (definitions)—

(a)in point (10), for “as defined in Article 1” substitute “and is to be construed in accordance with the definitions of ‘networked equipment with high network availability’ and ‘networked equipment with high network availability functionality’ in Article 2”;

(b)omit point (17).

(4) In Article 3(1) (obligations of suppliers), for point (b) substitute—

(b)the information set out in table 4 of Annex 5 (product information sheet) is made available on a publicly accessible website;.

(5) In Annex 1 (definitions for the purposes of the Annexes), after point (28) insert—

(29) declared values’ means the values provided by the supplier in the technical documentation in accordance with point (4) of Annex 6 for the verification of conformity by the market surveillance authority;

(30) guarantee’ means any undertaking by the dealer or the supplier to the consumer that, if an electronic display does not meet the specifications set out in the guarantee statement or in any associated advertising—

(a)the consumer will be reimbursed for the price paid for the electronic display; or

(b)the electronic display will be repaired, replaced or handled in any way..

(6) In Annex 2, in point B (energy efficiency index)—

(a)after the formula, in the explanation of term “A” in the formula, for “viewing surface area” substitute “visible screen area”;

(b)after the explanation of term “corr1” in the formula, insert—

For the purposes of the EEI calculation, the declared values of the following technical parameters listed in Table 5 of Annex 6 (technical documentation) must be used—

(a)on mode power demand (Pmeasured );

(b)visible screen area..

(7) In Annex 3, in point 2 (label design)—

(a)at the beginning of point (f) insert “Subject to point (g)”;

(b)after point (f) insert—

(g)If the electronic display does not support HDR—

(i)the following must not be displayed—

(aa)the HDR pictogram; and

(bb)the energy efficiency class; and

(ii)the screen pictogram, indicating screen size and resolution, must be vertically centred in the area below the indication of the energy consumption..

(10) In Annex 9 (verification procedure for market surveillance purposes)—

(a)for the first paragraph substitute—

The supplier of a product must not use the verification tolerances—

(a)as allowed tolerances to establish the declared values;

(b)to interpret the declared values; or

(c)to communicate better performance.

The values and classes published on the label or in the product information sheet must not be more favourable to the supplier than the declared values.;

(b)in point 2—

(i)in point (a), for “values given in the technical documentation pursuant to point 3 of Article 3 of Regulation (EU) 2017/1369 (declared values)” substitute “declared values”;

(ii)in point (c), for the words after “comply with” substitute—

Amendments to Commission Delegated Regulation (EU) 2019/2014: household washing machines and washer-dryers

5.—(1) Commission Delegated Regulation (EU) 2019/2014 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of household washing machines and household washer-dryers and repealing Commission Delegated Regulation (EU) No 1061/2010 and Commission Directive 96/60/EC(10), as modified by Schedule 2 to the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020, is amended as follows.

(2) In Article 3(1) (obligations of suppliers), for point (b) substitute—

(b)the information set out in Table 5 of Annex 5 (product information sheet for household washing machines) or, as the case may be, Table 6 of Annex 5 (product information sheet for household washer-dryers) is made available on a publicly accessible   website;.

(3) In Annex 1 (definitions applicable for the Annexes), after point (32) insert—

(33) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point 1(d) of Annex 6 (household washing machines) or point 2(d) of Annex 6 (household washer-dryers) for the verification of conformity by the market surveillance authority;

(34) ‘wash and dry cycle’ means a complete cycle for cotton laundry—

(a)which is continuous if the household washer-dryer provides a continuous cycle;

(b)where the washing cycle is the eco 40-60 programme; and

(c)where the drying cycle achieves cupboard dry status..

(4) In Annex 4 (measurement methods and calculations)—

(a)after the first paragraph insert—

Where a calculation in this Annex uses a parameter listed in Table 7 of Annex 6 (technical documentation for household washing machines) or Table 8 of Annex 6 (technical documentation for household washer-dryers), the supplier must use the declared value for that parameter.;

(b)in point 1 (rated capacity of household washer-dryers), in the first sentence, for “shall be measured, using” substitute “is the rated capacity of”;

(c)in point 3 (washing efficiency index)—

(i)in the existing paragraph, for “two decimal places” substitute “three decimal places”;

(ii)after the existing paragraph, insert as a paragraph—

For household washing machines with a rated capacity higher than 3 kg and for the washing cycle of household washer-dryers with a rated washing capacity higher than 3 kg, the value to be entered on the Product Information sheet for IW is the lowest of the values for—

(a)the washing efficiency index at the rated washing capacity;

(b)the washing efficiency index at half of the rated washing capacity; and

(c)the washing efficiency index at quarter of the rated washing capacity.

For household washing machines with a rated capacity lower than or equal to 3 kg and for the washing cycle of household washer-dryers with a rated capacity lower than or equal to 3 kg, the value to be entered on the Product Information Sheet for IW is the value for the washing efficiency index at the rated washing capacity.

For household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information sheet for JW is the lower of the values for—

(a)the washing efficiency index at the rated capacity; and

(b)the washing efficiency index at half of the rated capacity.

For household washer-dryers with a rated capacity lower than or equal to 3 kg, the value to be entered on the Product Information Sheet for JW is the value for the washing efficiency index at the rated capacity.;

(d)in point 4 (rinsing effectiveness), after the existing paragraph insert—

For household washing machines with a rated capacity higher than 3 kg and for the washing cycle of household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information Sheet for the IR is the highest of the values for—

(a)the rinsing effectiveness at rated washing capacity;

(b)the rinsing effectiveness at half of the rated washing capacity; and

(c)the rinsing effectiveness at quarter of the rated washing capacity.

For household washing machines with a rated capacity lower than or equal to 3 kg and for the washing cycle of household washer-dryers with a rated capacity lower than or equal to 3 kg, no value is to be entered on the Product Information Sheet for IR.

For household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information Sheet for JR is the higher of the values for—

(a)the rinsing effectiveness index at the rated capacity; and

(b)the rinsing effectiveness index at half of the rated capacity.

For household washer-dryers with a rated capacity lower than or equal to 3 kg, no value is to be indicated on the Product Information sheet for JR.;

(e)in point 6(2) (weighted water consumption), in the first paragraph, after “weighted water consumption” insert “of the wash and dry cycle”;

(f)in point 7 (remaining moisture content)—

(i)in the first paragraph, for “the nearest whole percent” substitute “one decimal place”;

(ii)after the formula, in the explanations of the terms used in the equation, in each place that it occurs, for “one decimal place” substitute “two decimal places”.

(g)in point 9 (low power modes)—

(This note is not part of the Regulations)

These Regulations make amendments to legislation in the field of ecodesign and energy labelling for energy-related products.

Parts 2 and 3 correct minor technical issues in retained EU tertiary legislation. Part 2 amends Commission Regulation (EU) 2019/424 of 15 March 2019 laying down ecodesign requirements for servers and data storage products pursuant to Directive 2009/125/EC of the European Parliament and of the Council and amending Commission Regulation (EU) No 617/2013 (EUR 2019/424). Part 3 amends Commission Delegated Regulations relating to the energy labelling of electronic displays, household washing machines and household washer-dryers, refrigerating appliances, and household dishwashers (EUR 2019/2013, EUR 2019/2014, EUR 2019/2016 and EUR 2019/2017 respectively).

The amendments in Part 2 and 3 are closely aligned with the amendments made by the European Union to the underlying EU legislation. The amending EU measures are Commission Regulation (EU) 2021/341 of 23 February 2021 amending Regulations (EU) 2019/424, (EU) 2019/1781, (EU) 2019/2019, (EU) 2019/2020, (EU) 2019/2021, (EU) 2019/2022, (EU) 2019/2023 and (EU) 2019/2024 with regard to ecodesign requirements for servers and data storage products, electric motors and variable speed drives, refrigerating appliances, light sources and separate control gears, electronic displays, household dishwashers, household washing machines and household washer-dryers and refrigerating appliances with a direct sales function (OJ L 68, 26.2.2021, p. 108-148) and Commission Delegated Regulation (EU) 2021/340 of 17 December 2020 amending Delegated Regulations (EU) 2019/2013, (EU) 2019/2014, (EU) 2019/2015, (EU) 2019/2016, (EU) 2019/2017 and (EU) 2019/2018 with regard to energy labelling requirements for electronic displays, household washing machines and household washer-dryers, light sources, refrigerating appliances, household dishwashers, and refrigerating appliances with a direct sales function (OJ L 68, 26.2.2021, p. 62-107).

Parts 4 and 5 update the tables in Schedule 1 to the Ecodesign for Energy-Related Products Regulations 2010 (S.I. 2010/2617) and Schedule 1 to the Energy Information Regulations 2011 (S.I. 2011/1524) to ensure that the market surveillance authorities in England and Wales and Scotland can enforce the relevant measures for energy-related products.

A full impact assessment has not been produced for this instrument as no significant impact on the private, voluntary or public sector is foreseen.
