Proposed amendments to Ontario Regulation 468/18 under the Cannabis Licence Act, 2018

Summary of Proposal:
Cannabis delivery and curbside pick-up have been temporarily authorized under the Reopening Ontario (A Flexible Response to COVID-19) Act, 2020 (ROA) to provide consumers with ongoing access to legal recreational cannabis and help support cannabis retailers during the pandemic.
On December 2, 2021, the Supporting People and Businesses Act, 2021 received Royal Assent. The Act includes amendments to Ontario's cannabis statutes that would, once proclaimed into force, enable cannabis retailers to offer delivery and curbside pick-up services on a permanent basis. The Act also enables regulatory amendments to establish the rules that would govern these services.
Proposed amendments to O. Reg. 468/18 under the Cannabis Licence Act, 2018 (CLA) would establish rules to govern delivery and curbside pick-up services offered by provincially authorized cannabis retailers. The proposed rules support Ontario's objectives of protecting youth and keeping communities safe as well as combatting the illegal market, with respect to cannabis legalization.

Analysis of Regulatory Impact:
There are no new administrative costs associated with the proposed amendments. They would continue to provide cannabis retailers with economic opportunities, as well as offer cannabis consumers more choice and convenience. Retailers are not required to provide delivery and curbside pick-up services; the regulatory amendments would simply provide them with the opportunity to do so.
