OBJECTS AND REASONS

This Bill would amend the Interpretation Act, Cap. 1 and the Evidence Act, Cap. 121 in order to increase the categories of persons before whom an affidavit may be sworn or affirmed, in each case.

ENACTED by the Parliament of Barbados as follows:

Short title

This Act may be cited as the Evidence (Miscellaneous Provisions) Act, 2019. 1.

Amendment of enactments set out in Schedule

The enactments set out in the first column of the Schedule are amended in the respect set out opposite thereto in the second column. 2.

In section 27,

(a) inser t immediate ly af ter the words "any court" appearing in subsection (1) the words "any attorney-at-law,"; and

(b) insert immediately after the words "exercised by" appearing in subsection (4) the words "an attorney-at-law, or".

1. Renumber section 167 as section 167(1).

2. Insert after section 167(1) as renumbered, the following:

"(2) Without affecting subsection (1), an affidavit may be sworn or affirmed before an attorney-at-law.".
