The purpose of this consultation is to get your feedback on the fee proposal for biocides products.

Health Canada is also holding a separate consultation on the proposed Biocides Regulations. We encourage you to take part in that consultation as well.

Who is the focus of this consultation

We are looking for feedback from interested members from the public and consumers as well as the biocides industry, including stakeholders from the following sectors:

  • Disinfectants
  • Sanitizers

Key items for comment

The COVID-19 pandemic has created an unprecedented demand for health products in Canada, including disinfectants and surface sanitizers (biocides). Right now, Health Canada regulates biocides under two separate frameworks, with each product being subject to different requirements, fees, and timelines, despite having similar risks, benefits, uses, and ingredients. This has led to challenges for industry, such as product classification issues, differences in administrative burden for companies, and potential hurdles for greater international alignment.

In order to address these challenges, Health Canada is looking to regulate these products under a single regime. The new framework would transfer disinfectants regulated under the Food and Drug Regulations (FDR) and certain surface sanitizers regulated under the Pest Control Products Act (PCPA), to the proposed Biocides Regulations. As the proposed Biocides Regulations fall under the Food and Drugs Act (FDA), Health Canada exercises the Ministerial authorities to set fees under this legislation for biocides. The proposed biocide fees are based on the current approach to fees related to drugs and medical devices.

We want to get your feedback on the fee proposal for biocides, which lays out the fee structure and performance standards associated with biocides products.
