CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Ministerial Condition No. 21069

Ministerial condition

(Paragraph 84(1)(a) of the Canadian Environmental Protection Act, 1999)

Whereas the Minister of the Environment and the Minister of Health (the ministers) have assessed information pertaining to the substance 2-pyrrolidinone, 1-butyl-, Chemical Abstracts Service Registry Number 3470-98-2;

And whereas the ministers suspect that the substance is toxic or capable of becoming toxic within the meaning of section 64 of the Canadian Environmental Protection Act, 1999 (the Act);

The Minister of the Environment, pursuant to paragraph 84(1)(a) of the Act, hereby permits the manufacture or import of the substance subject to the conditions of the following annex.

ANNEX

Conditions

(Paragraph 84(1)(a) of the Canadian Environmental Protection Act, 1999)

1. The following definitions apply in these ministerial conditions:

“coating”: means a consumer product either in liquid or aerosol form, to which the Canada Consumer Product Safety Act applies, that is intended to be applied onto or impregnated into a substrate and that is water-based, alcohol-based, oil based or solvent-based, and includes interior and exterior paint, wood stain, primer, varnish and lacquer, whether tinted or untinted;
“cosmetic”: means a cosmetic as defined in section 2 of the Food and Drugs Act;
“notifier”: means the person who has, on December 20, 2021, provided to the Minister of the Environment the prescribed information concerning the substance, in accordance with subsection 81(1) of the Canadian Environmental Protection Act, 1999; and
“substance”: means 2-pyrrolidinone, 1-butyl-, Chemical Abstracts Service Registry Number 3470-98-2.

2. The notifier may manufacture or import the substance subject to the present ministerial conditions.

Restrictions

3. The notifier shall not import the substance if it is present in:

(a) any cosmetic; or
(b) any coating when the substance is in a concentration greater than 8% by weight.

4. The notifier shall not import or manufacture the substance to use it to manufacture the following:

(a) any cosmetic; or
(b) any coating when the substance is in a concentration greater than 8% by weight.

5. The notifier shall transfer the physical possession or control of the substance only to a person who agrees to use it in accordance with section 4.

Other requirements

6. The notifier shall, prior to transferring the physical possession or control of the substance to any person:

(a) inform the person, in writing, of the terms of the present ministerial conditions; and
(b) obtain, prior to the first transfer of the substance, written confirmation from the person that they were informed of the terms of the present ministerial conditions and agree to comply with the use conditions specified in section 4.

Record-keeping requirements

7. (1) The notifier shall maintain electronic or paper records, with any documentation supporting the validity of the information contained in these records, indicating:

(a) the specific use of the substance;
(b) the quantity of the substance that the notifier manufactures, imports, purchases, distributes, sells and uses;
(c) the name and address of each person to whom the notifier transfers the physical possession or control of the substance;
(d) the concentration by weight of the substance in the coating imported or manufactured with the substance; and
(e) the written confirmation referred to in section 6.

(2) The notifier shall maintain electronic or paper records mentioned in subsection (1) at their principal place of business in Canada, or at the principal place of business in Canada of their representative, for a period of at least five years after they are made.

Coming into force

8. The present ministerial conditions come into force on May 17, 2022.

Publication of the draft science assessment of benzene releases from gasoline stations and implications for human health

Whereas the Government of Canada has conducted a draft science assessment of benzene releases from gasoline stations and implications for human health pursuant to paragraphs 68(b) and (c) of the Canadian Environmental Protection Act, 1999;

The synopsis of the draft science assessment conducted on benzene releases from gasoline stations is annexed hereby.

Public comment period

Any person may, within 60 days after publication of this notice, file with the Minister of Health written comments on the scientific considerations in the draft science assessment. More information regarding the scientific considerations may be obtained from the Canada.ca (Environmental and Workplace Health) website. All comments must cite the Canada Gazette, Part I, and the date of publication of this notice and be addressed to the Water and Air Quality Bureau, Health Canada, 269 Laurier Avenue West, AL 4903B, Ottawa, Ontario K1A 0K9, or sent by email to air@hc-sc.gc.ca.

ANNEX

Synopsis of the draft science assessment of benzene releases from gasoline stations and implications for human health

Benzene is a recognized human carcinogen and, as such, a component of particular concern in gasoline. The objective of this assessment is to estimate the contribution of benzene emissions to inhalation exposures for communities residing in proximity to gasoline stations.

Two emission pathways are considered: long-term continuous benzene emissions via evaporative losses from gasoline station operations and short-term benzene emissions during tanker truck fuel unloading.

Air dispersion modelling was used to estimate annual average benzene concentrations attributable to gasoline station emissions for varying distances from the gasoline station fenceline. Specific scenarios assessed include gasoline stations with baseline, median, and high yearly gasoline throughputs. Air dispersion modelling was also used to estimate the average benzene concentrations at different distances from the gasoline station fenceline during the one-hour time of average-sized tanker truck unloading, assuming the absence of vapour recovery and vent valves. For both types of releases, it is concluded that the inhalation exposures to benzene attributable to gasoline station emissions may pose unacceptable risks to human health for the general population living in the vicinity.

There are measures that can be taken to reduce benzene exposures and human health risks associated with benzene emissions from gasoline stations. These include the national implementation of vapour recovery at gasoline stations, the use of pressure/vacuum (p/v) valves on vent stacks, and the implementation of minimum setback distances for new construction. These measures could contribute to a decrease in benzene exposure for the general population in Canada, including potentially vulnerable populations such as pregnant people and children.
