STATUTORY RULES AND ORDERS NO. 7 OF 2022.

REGULATIONS

MADE by the Minister under section 30 of the Environmental Health Services Act, Chap. 42:01.

(Gazetted 17th February, 2022.)

1. These Regulations may be cited as the –

ENVIRONMENTAL HEALTH SERVICES (COVID-19) (AMENDMENT)

REGULATIONS, 2022.

2. In these Regulations, the Environmental Health Services (COVID-19) Regulations, 2021, is referred to as “the Principal Regulations”.

3. Regulation 2 of the Principal Regulations is amended –

(a) in the definition of “self-quarantine” by deleting the word “symptoms.” and substituting the word “symptoms;”;

(b) inserting the following definition after the definition of self-quarantine:

“ “special event” means an event permitted under regulation 8A(2A).”.

4. The Principal Regulations is amended by deleting regulation 5.

5. Regulation 6 is repealed and replaced by the following:

6. (1) A person in Dominica who develops flu-like symptoms or who may have had contact with someone who is infected with COVID-19 shall immediately inform the Ministry with responsibility for health.

(2) A person who fails to comply with subregulation (1) commits an offence.”.

6. Regulation 8(4) of the Principal Regulations is amended by inserting the following new subregulation (6):

“(6) This regulation does not apply to a special event.”.

7. Regulation 8A of the Principal Regulations is amended by inserting the following new subregulations immediately after subregulation (2) –

“(2A) The Chief of Police may, on the recommendation of the Events Task Force approved by the Cabinet, permit a special event.

(2B) Where a gathering is permitted as a special event under subregulation (2A), the host, patrons and other participants shall adhere to the Special Events Protocols established and published by the Ministry of Health.

(2C) A special event must not exceed the period of time authorised by the Chief of Police and there must not be more than five hundred patrons in attendance.”.

8. Regulation 9 of the Principal Regulations is amended –

(a) in subregulation (1) by deleting the words “and published by the Chief Medical Officer” and substituting the words “by the Ministry with responsibility for health”;

(b) in subregulation (2)(b) by –

(a) inserting the word “loud” immediately before the word “music”;

(b) deleting paragraph (iii).

9. Regulation 11 of the Principal Regulations is amended –

(a) in subregulation (1) by:

(i) deleting the words “Chief Medical Officer and substituting “Ministry of Health”;

(ii) deleting the words “one hundred” and substituting the words “one hundred and fifty”;

(b) by deleting subregulation (4).

10. Regulation 12 of the Principal Regulations is repealed and replaced as follows:

12. (1) Subject to regulation 7, all educational places of instruction may be open in accordance with protocols established and published by the Ministry of Health.

(2) Subregulation (1) does not prohibit any activity referred to in this subregulation that is conducted by electronic or virtual means.

(3) All educational places of instruction shall ensure that persons maintain physical distancing of no less than six feet in or outside the place of instruction.

11. The Principal Regulations are amended by inserting the following new regulation 12A after regulation 12:

12A. Subject to compliance with the Special Events Protocols and any Sporting Protocols, established and published by the Ministry of Health, a person may host or attend a recreational or competitive sporting event.”.

12. Regulation 13(1) of the Principal Regulations is amended-

(a) in paragraph (a) by deleting the words “private party” and substituting the words “party on residential premises”;

(b) by deleting paragraph (b).
