USE OF HIGHWAY AND RULES OF THE ROAD AMENDMENT REGULATION

on June 15, 2022 pursuant to section 112 of the Traffic Safety Act.
1 The Use of Highway and Rules of the Road Regulation
(AR 304/2002) is amended by this Regulation.
2 The following is added after section 22:
Passing stopped vehicle with flashing lamps
22.1(1) When passing a stopped vehicle with its flashing lamps
operating, a person driving a vehicle shall not
(a) drive in a traffic lane occupied, or partly occupied, by the
stopped vehicle with its flashing lamps operating, or
(b) drive in a traffic lane adjacent to the stopped vehicle with its
flashing lamps operating,
if there is another traffic lane, for traffic moving in the same
direction as the vehicle, further from the stopped vehicle into which
the vehicle can move safely.
(2) When a person is attempting to move a vehicle into a traffic lane
further from a stopped vehicle in compliance with subsection (1), any
person driving a vehicle in the further traffic lane shall take
reasonable precautions to allow the vehicle to safely move into that
further traffic lane.
(3) Subsection (1) does not apply
(a) where a speed limit is prescribed under section 108(1)(g) of
the Act, or
(b) when the stopped vehicle is a school bus on which are
displayed the words "school bus".
Overtaking and passing snow plows
22.2 A person driving a vehicle shall not drive the vehicle so as to
overtake and pass or attempt to overtake or to pass a snow plow
when
(a) the view along the side of the snow plow is obstructed,
(b) the act of overtaking and passing impedes the operation of
the snow plow, or
(c) the act of overtaking and passing cannot be done safely.
3 Section 70 is repealed.
4 Section 113 is amended
(a) by adding
section 22.1(1) and (2);
section 22.2;
after
section 22(2)(b);
(b) by striking out
sections 70 to 72;
and substituting
sections 71 and 72;
5 The following is added after section 113:
Expiry
113.01 For the purpose of ensuring that this Regulation is
reviewed for ongoing relevancy and necessity, with the option that it
may be repassed in its present or an amended form following a
review, this Regulation expires on June 1, 2032.
6(1) This Regulation, except sections 2 and 4(a), comes
into force on March 1, 2023.
(2) Sections 2 and 4(a) come into force on the coming into
force of the Traffic Safety Amendment Act, 2022.
