(M.O. 28/2022) on June 17, 2022 pursuant to section 12(2) of the Provincial Parks
Act.
1 The Provincial Parks (General) Regulation (AR 102/85) is
amended by this Regulation.

2 Section 1 is amended
(a) by adding the following after clause (d.1):
(d.11) "Directive" means the Provincial Parks (General)
Directive incorporated under section 2.1;
(b) by adding the following before clause (j):
(i.1) "hunt" has the same meaning as in the Wildlife Act;
(c) by adding the following after clause (n):
(o) "wildlife" has the same meaning as in the Wildlife Act.

3 The following is added after section 1.1:
Interpretation - Directive
1.2 A reference in this Regulation to "this Regulation" includes the
Directive.

4 The following is added after section 2:
Incorporation of Directive
2.1(1) The Provincial Parks (General) Directive, set under section
12.12 of the Act, as amended or replaced from time to time, is
incorporated into and forms part of this Regulation.
(2) Without limiting the incorporation by reference or directive
powers in the Act, when a provision in this Regulation authorizes
any thing or action to be permitted, specified, governed, regulated,
prohibited or exempted in the Directive,
(a) the Directive may include rules respecting all provincial
parks and recreation areas or in respect of either in general, to
particular provincial parks or recreation areas or categories of
them or to particular parts of identified provincial parks or
recreation areas or categories of them, and
(b) the Directive may include terms and conditions and a person
must comply with the terms and conditions.

5 Section 3 is amended by striking out "and" at the end of
clause (a), by adding "and" at the end of clause (b) and by
adding the following after clause (b):
(c) the Directive.

6 Section 11.1 is repealed and the following is substituted:
Big game
11.1(1) In this section, "big game" has the same meaning as in the
Wildlife Act.
(2) No person shall dress, hang or store big game in a provincial
park or recreation area unless permitted by the Directive.

7 Section 11.3 is repealed and the following is substituted:
Feeding of wildlife
11.3 Subject to section 11.4, no person shall feed wildlife in a
provincial park or recreation area unless permitted by the Directive.
Baiting of wildlife
11.4(1) In this section, "bait" has the same meaning as in the
Wildlife Regulation (AR 143/97).
(2) No person shall use bait to attract wildlife in a provincial park or
recreation area unless permitted by the Directive.

8 Sections 15 to 17 are repealed and the following is
substituted:
Animal control generally
15(1) In this section and in sections 16, 17 and 18, "owner"
includes any person
(a) having temporary or permanent custody, care or possession
of an animal, or
(b) who brought an animal into a provincial park or recreation
area.
(2) When an animal is in a provincial park or recreation area, the
owner shall have control of the animal as specified in the Directive.
(3) When an animal defecates in a provincial park or recreation area,
the owner shall remove the excrement as specified in the Directive.
Animals prohibited in certain places
16 An owner of an animal shall not allow the animal to enter or
remain in or on all or any part of a provincial park or recreation area
that is specified in the Directive.
Application
16.1 Sections 15(3) and 16 do not apply to a guide dog used by a
person in accordance with the Blind Persons' Rights Act.
Rights of conservation officers re animals
17 A conservation officer may require an owner to remove from a
provincial park or recreation area any animal that the officer
considers is not under control or may be a nuisance or danger to the
life, safety, health or property of any person.

9 Section 18 is amended
(a) in subsection (2)(b) by striking out "or person having
custody of the animal";
(b) in subsection (3) by striking out "of or the person who
has custody of and" and substituting "or a person acting
on the owner's behalf".

10 Section 19 is repealed.

11 Section 46(1)(c) and (1.1)(b) are amended by striking
out "the Lakeland Provincial Recreation Area" and substituting "a
recreation area specified in the Directive".

12 This Regulation comes into force on September 15,
2022.
