COMMERCIAL VEHICLE CERTIFICATE AND INSURANCE AMENDMENT REGULATION

13, 2022 pursuant to sections 18(2)(a), 64(u) and 156 of the Traffic Safety Act.
1 The Commercial Vehicle Certificate and Insurance
Regulation (AR 314/2002) is amended by this Regulation.
2 Section 1(h) is amended by striking out "or Division 3 of Part
2".
3 Section 1.2(2)(a) is amended by striking out "20(2)(g),".
4 The heading preceding section 2 is amended by striking
out "for Freight Trucks".
5 Section 2 is amended
(a) by adding the following after subsection (1):
(1.1) No person may operate a commercial vehicle in respect of
which, under the Act, a certificate of registration is issued,
having a manufacturer's seating capacity originally designed for
11 passengers or more, including the driver, that is used or
intended to be used to transport passengers on a highway, unless
the operation of the vehicle is carried out under the authority of a
safety fitness certificate.
(b) in subsection (2) by adding "or passengers" after "used
to transport goods";
(c) in subsection (3) by striking out "Subsection (1) does
not" and substituting "Subsections (1) and (1.1) do not";
(d) in subsection (4) by striking out "subsection (1)" and
substituting "subsections (1) and (1.1)".
6 Section 3 is repealed and the following is substituted:
Application for safety fitness certificate
3 The registered owner of one or more commercial vehicles that
require a safety fitness certificate under section 2(1) and (1.1) must
apply to the Registrar for a safety fitness certificate authorizing the
operation of those commercial vehicles.
7 Section 3.1(1) is amended by adding "used or intended to be
used to transport goods on a highway" after "one or more commercial
vehicles".
8 Section 4.1(1) is repealed and the following is
substituted:
Application for an amendment
to a safety fitness certificate
4.1(1) An application for amendment of a safety fitness certificate
by a registered owner must be accompanied by a description of the
amendment requested and the reasons for it.
9 Section 5 is repealed.
10 Division 3 of Part 2 is repealed.
11 Section 45 is amended by renumbering it as section 45(1)
and by adding the following after subsection (1):
(2) The Registrar may at any time exempt a person, organization or
vehicle from any of the requirements of this Regulation, subject to
any terms and conditions the Registrar considers appropriate.
(3) An exemption under subsection (2) may apply to a specific
person, organization or vehicle, or a class or group of persons,
organizations or vehicles.
(4) The Registrar may inform the person, organization or the owner
of the vehicle that is the subject of an exemption under subsection
(2) of the status of the exemption by
(a) providing notice to the person, organization or owner in
accordance with section 6(a), (b) or (c) of the Act,
(b) publishing the notice of exemption electronically on the
website of the Minister's Department, or
(c) doing both clauses (a) and (b).
(5) A person, organization or owner to whom an exemption applies
shall comply with the terms and conditions prescribed by the
Registrar under subsection (2).
12 Section 55 is amended
(a) by adding "(1.1)," after "section 2(1),"
(b) by striking out the following:
section 19(1), (2);
section 20(1);
(c) by adding
section 45(5);
after
section 42(1), (2);
13 Section 62 is amended by renumbering it as section
62(1) and by adding the following after subsection (1):
(2) A safety fitness certificate issued under Division 3 of Part 2 on
or before December 1, 2022 is continued as if it were issued under
Part 1.
14 Schedule 2 is amended by striking out the following:
(3) Application for amendment of a safety
fitness certificate 0
15 This Regulation comes into force on December 1, 2022.
