VEHICLE INSPECTION AMENDMENT REGULATION
For information only: Made by the Minister of Transportation (M.O. 05/22) on July
13, 2022 pursuant to sections 81 and 156 of the Traffic Safety Act.
1 The Vehicle Inspection Regulation (AR 211/2006) is
amended by this Regulation.
2 Section 7(2) is amended
(a) in clause (c) by striking out "the name, address, e-mail
address if any and telephone number" and substituting
"the name and address";
(b) by repealing clauses (d)(iii) and (iv) and (e).
3 Section 9 is repealed.
4 Section 27 is amended
(a) by repealing subsection (5);
(b) in subsection (6) by striking out "Without limiting the
generality of subsection (5)(a), a licensee" and
substituting "A licensee";
(c) by repealing subsection (7).
5 Section 28 is repealed and the following is substituted:
Completing a certificate
28 A technician who completes a certificate pursuant to section 27
shall complete the information required on the certificate according
to the procedures set out in the applicable Vehicle Inspection
Manual.
6 Section 29 is repealed and the following is substituted:
Issuing record of inspection
29 On completion of the inspection of a vehicle, whether or not the
vehicle has passed the inspection,
(a) the technician shall complete a record of inspection for the
vehicle in accordance with the applicable Vehicle Inspection
Manual and take any other steps required by the Vehicle
Inspection Manual, and
(b) the licensee shall give to the person who submitted the
vehicle for inspection the record of inspection and take any
other steps required by the Facility Operating Manual.
7 Section 33(6) is repealed.
8 Section 34 is amended
(a) by repealing subsections (6) and (7) and
substituting the following:
(6) Where a certificate is revoked, an investigator, or a
technician at the request of an investigator, shall remove from the
vehicle and destroy the decal affixed to the vehicle in respect of
the certificate.
(7) Notwithstanding subsection (6), where a certificate is
revoked and an investigator or a technician, as the case may be,
is unable to remove and destroy the decal, the owner or operator
of the vehicle in respect of which the revocation is made shall, at
the request of the Registrar, the investigator or the technician,
remove from the vehicle and destroy the decal affixed to the
vehicle in respect of the certificate.
(b) in subsection (8) by striking out "to take possession of
the certificate or".
9 Section 39(1)(c) is amended by striking out "Schedule" and
substituting "Facility Operating Manual".
10 Section 40 is amended
(a) in subsection (1)
(i) in clause (b) by striking out "Schedule" and
substituting "Facility Operating Manual";
(ii) by adding "and" at the end of clause (d) and by
repealing clause (e);
(b) in subsection (7) by striking out "Schedule" and
substituting "Facility Operating Manual".
11 Section 47 is amended
(a) in subsection (1)
(i) by adding "and" at the end of clause (c) and by
repealing clause (d);
(ii) in clause (e) by striking out "referred to in clause (d)";
(b) by repealing subsection (2)(c).
12 Section 49(2) is amended by striking out "and can
demonstrate continuing competency under section 74".
13 Part 5 is repealed.
14 Section 84(1) is repealed.
15 Section 86 is amended
(a) by striking out "section 9";
(b) by striking out "section 27(1), (2), (3), (4), (5)(a), (b), (c)
and (d), (6), (7)(a) and (b)" and substituting "section
27(1), (2), (3), (4) and (6)";
(c) by striking out "section 28(1)(a), (b), (c), (d) and (e), (2)"
and substituting "section 28";
(d) by striking out "section 29(1)(a), (b) and (c), (2)(a)
and (b)" and substituting "section 29(a) and (b)";
(e) by striking out "section 33(6)";
(f) by striking out "section 84(1) and (4)" and substituting
"section 84(4)".
16 The following is added after section 91:
Expiry
91.1 For the purpose of ensuring that this Regulation is reviewed
for ongoing relevancy and necessity, with the option that it may be
repassed in its present or an amended form following a review, this
Regulation expires on October 1, 2028.
17 The Schedule is repealed.
18 This Regulation comes into force on December 1, 2022.
