The Legislature of New South Wales enacts—

1 Name of Act This Act is the Road Transport Amendment (Prohibition of U-turns and 3-point Turns in School Zones) Act 2022.

2 Commencement This Act commences on the date of assent to this Act.

Schedule 1 Amendment of Road Rules 2014 Rule 42–1 Insert after rule 42—

42–1 NSW rule: making a U-turn or 3-point turn in a school zone (1) A driver must not make a U-turn or perform a 3-point turn on a road in a school

zone during the times indicated on the school zone sign on a road, or the road, into the zone. Maximum penalty—20 penalty units.

(2) Subrule (1) does not apply— (a) if complying with the rule is unsafe or impractical, or (b) if there is a school traffic management plan for the school zone—in the

circumstances under which making U-turns and performing 3-point turns are permitted in the school traffic management plan, or

(c) in the circumstances under which making U-turns and performing 3-point turns are permitted by an agreement in writing, in force at the time the U-turn is made or the 3-point turn is performed, between— (i) the Local Area Commander within the NSW Police Force for the

local area the school is in, and (ii) the school administration authority.

(3) In this rule— 3-point turn means a driving manoeuvre performed to turn a vehicle around within the boundaries of a road if the road is not wide enough to make a U-turn. school administration authority means— (a) for a government school within the meaning of the Education Act

1990—the operational directorate of the Department of Education responsible for the school, or

(b) otherwise—the proprietor, within the meaning of the Education Act 1990, or principal of the individual school or, for a registered non-government school that is a member of a system of non-government schools within the meaning of the Education Act 1990, the approved authority for the system.

school traffic management plan, for a school zone, means a document describing how traffic is to be controlled on public roads in the school zone to provide for the safe flow of traffic approved by the school administration authority for the school. school zone has the meaning given by rule 23(2). Note— This rule is an additional NSW road rule. There is no corresponding rule in the Australian Road Rules.
