Certain concrete reinforcing bar — Decision

Decision

On September 22, 2020, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated an investigation into the alleged injurious dumping of certain concrete reinforcing bar from Algeria, Egypt, Indonesia, Italy, Malaysia, Singapore and Vietnam.

The subject goods are usually classified under the following tariff classification numbers:

  • 7213.10.00.00
  • 7214.20.00.00

In some instances, imports of the subject goods may also be classified under the following tariff classification numbers:

  • 7215.90.00.90
  • 7227.90.00.90

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping. During the COVID-19 pandemic, written submissions must be sent electronically to simaregistry@cbsa-asfc.gc.ca. To be given consideration in this investigation, the CBSA should receive this information by January 29, 2021.

Any information submitted by interested persons concerning this investigation will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY (E-REGISTRY PILOT PROJECT)

Concrete reinforcing bar

The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2020-004) to determine whether the evidence discloses a reasonable indication that the dumping of hot-rolled deformed steel concrete reinforcing bar in straight lengths or coils, commonly identified as rebar, in various diameters up to and including 56.4 mm, in various finishes, excluding plain round bar and fabricated rebar products, originating in or exported from the People’s Democratic Republic of Algeria, the Arab Republic of Egypt, the Republic of Indonesia, the Italian Republic, Malaysia, the Republic of Singapore and the Socialist Republic of Vietnam (the subject goods), has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA. The product definition also excludes “10-mm-diameter (10M) rebar produced to meet the requirements of CSA G30 18.09 (or equivalent standards) and coated to meet the requirements of epoxy standard ASTM A775/A 775M 04a (or equivalent standards) in lengths from 1 foot (30.48 cm) up to and including 8 feet (243.84 cm).”

The Tribunal’s preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before October 5, 2020. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before October 5, 2020.

Submissions by parties opposed to the complaint must be filed not later than noon, on October 20, 2020. The complainants, as well as supporting parties, may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on October 27, 2020.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-045) from 1091847 Ontario Ltd. of Ottawa, Ontario, concerning a procurement (Solicitation No. 2BSCS12031/A) made by Shared Services Canada (SSC) on behalf of the Administrative Tribunals Support Service of Canada. The solicitation was for CheckPoint Azure firewall support and licences. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 23, 2020, to conduct an inquiry into the complaint.

1091847 Ontario Ltd. alleges that the procurement was conducted improperly, that the request for proposal included restrictive specifications, that SSC did not grant it access to necessary technical information and did not permit sufficient time to submit its bid.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-039) from Construction Galipeau Inc. (Galipeau), of L’Ancienne-Lorette, Quebec, concerning a procurement (Solicitation No. EE517-190005/A) made by the Department of Public Works and Government Services. The solicitation was for the provision of general contracting services for Government of Canada buildings situated in the City of Québec region and for Les Escoumins, Quebec. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on September 16, 2020, to conduct an inquiry into the complaint.

Galipeau alleges irregularities in the procurement process.
