DESIGNATION AND TRANSFER OF RESPONSIBILITY AMENDMENT REGULATION

For information only: Made by the Lieutenant Governor in Council (O.C. 373/2022) on November 16, 2022 pursuant to sections 2, 16, 17 and 18 of the Government Organization Act. 1 The Designation and Transfer of Responsibility Regulation (AR 214/2022) is amended by this Regulation. 2 Section 2 is amended (a) in subsection (1)(e) by adding "Part 3 of the" before "Student Financial Assistance Act"; (b) by repealing subsection (2) and substituting the following: (2) The Minister of Advanced Education is designated as having common responsibility with (a) the Minister of Infrastructure for (i) section 3 of Schedule 1 to the Government Organization Act, and (ii) sections 80 and 99(1)(a) and (2) to (6) of the Post-secondary Learning Act, and (b) the Minister of Skilled Trades and Professions for the Student Financial Assistance Act, except Part 3. 3 Section 3 is amended (a) by repealing subsection (1)(b) and (q); (b) by repealing subsection (3) and substituting the following: (3) The Minister of Affordability and Utilities is declared to be the Minister responsible for the following enactments: (a) An Act to Cap Regulated Electricity Rates; (b) Utility Commodity Rebate Act; (c) Utility Payment Deferral Program Act. 4 Section 4 is amended (a) in subsection (1) (i) by adding the following after clause (k): (k.1) Drainage Districts Act; (ii) by repealing clause (y) and substituting the following: (y) Stray Animals Act, except section 9; (b) in subsection (5) by striking out "and program 6.1, Resource Management"; (c) by adding the following after subsection (5): (6) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (7) and (8) is transferred to the Minister of Agriculture and Irrigation. (7) The responsibility for the administration of the unexpended balance of the portion of program 2.1, Rural Programming, related to rural life enhancement of the 2022-23 Government appropriation for Affordability and Utilities is transferred to the Minister of Agriculture and Irrigation. (8) The responsibility for the administration of the unexpended balance of the portion of program 1, Ministry Support Services, related to Water Infrastructure Management of the 2022-23 Government appropriation for Environment and Protected Areas is transferred to the Minister of Agriculture and Irrigation. 5 Section 6(1) is amended by adding the following after clause (b): (b.1) Alberta Get Outdoors Weekend Act; 6 Section 9 is amended (a) in subsection (1) (i) by repealing clauses (f) and (r); (ii) in clause (u) by adding "section 6," after "except"; (iii) by repealing clause (v); (b) by repealing subsection (3) and substituting the following: (3) The Minister of Environment and Protected Areas is designated as having common responsibility with (a) the Minister of Forestry, Parks and Tourism for (i) section 37(1)(d) to (j) of the Environmental Protection and Enhancement Act, (ii) the Forest Reserves Act, (iii) the Public Lands Act, and (iv) the Wilderness Areas, Ecological Reserves, Natural Areas and Heritage Rangelands Act, (b) the Minister of Public Safety and Emergency Services for section 34.4(2)(a) of the Fisheries (Alberta) Act, (c) the Minister of Infrastructure for sections 4 to 9 of Schedule 5 to the Government Organization Act, (d) the Minister of Service Alberta and Red Tape Reduction for section 5(1)(d) and (2)(b) of the Surveys Act, (e) the Minister of Agriculture and Irrigation for section 6 of the Water Act, (f) the Minister of Agriculture and Irrigation and the Minister of Transportation and Economic Corridors for Part 6 and sections 159 and 163 of the Water Act, and (g) the Minister of Public Safety and Emergency Services for section 86(2)(a) of the Wildlife Act. 7 Section 10 is amended (a) in subsection (1) by adding the following after clause (c): (c.1) section 9 of the Stray Animals Act; (b) by adding the following after subsection (1): (1.1) The Minister of Forestry, Parks and Tourism and the Minister of Transportation and Economic Corridors are designated as having common responsibility for sections 14 and 15 of the Provincial Parks Act. (c) in subsection (5)(b) by striking out ", program 4, Water and program 6.3, Environmental Emergency Response," and substituting "and program 4, Water,"; (d) by adding the following after subsection (5): (6) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (7) to (9) is transferred to the Minister of Forestry, Parks and Tourism. (7) The responsibility for the administration of the unexpended balance of the portion of program 1, Ministry Support Services, related to Forests of the 2022-23 Government appropriation for Agriculture and Irrigation is transferred to the Minister of Forestry, Parks and Tourism. (8) The responsibility for the administration of the unexpended balance of the portion of program 3.2, Public Land Management, related to conservation officers of the 2022-23 Government appropriation for Environment and Protected Areas is transferred to the Minister of Forestry, Parks and Tourism. (9) The responsibility for the administration of the unexpended balance of the portion of program 2.2, Industry and Regional Development, related to tourism policy and relations of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Forestry, Parks and Tourism. 8 Section 11 is amended (a) in subsection (1) (i) in clause (l) by adding ", except section 3.1," after "Schedule 7.1"; (ii) by repealing clause (x) and substituting the following: (x) Pharmacy and Drug Act, except section 34; (iii) by adding the following after clause (aa): (aa.1) Radon Awareness and Testing Act; (b) in subsection (2) (i) by repealing clause (a); (ii) by adding the following after clause (b): and (c) the Minister of Mental Health and Addiction for (i) section 3.1 of Schedule 7.1 to the Government Organization Act, and (ii) section 34 of the Pharmacy and Drug Act. (c) by repealing subsections (3) and (4). 9 Section 14 is amended (a) by repealing subsection (1) and substituting the following: Jobs, Economy and Northern Development 14(1) The Minister of Jobs, Economy and Northern Development is designated as the Minister responsible for the following enactments: (a) Blind Workers' Compensation Act; (b) Burial of the Dead Act; (c) Employment Standards Code; (d) Film and Television Tax Credit Act; (e) Heroes' Compensation Act; (f) Investing in a Diversified Alberta Economy Act; (g) Labour Relations Code; (h) Managerial Exclusion Act; (i) MLA Compensation Act; (j) Northern Alberta Development Council Act; (k) Occupational Health and Safety Act; (l) Police Officers Collective Bargaining Act; (m) Post-traumatic Stress Disorder (PTSD) Awareness Day Act; (n) Promoting Job Creation and Diversification Act; (o) section 8(6) of the Public Education Collective Bargaining Act; (p) Public Service Employee Relations Act; (q) Special Payment Act; (r) Workers' Compensation Act. (b) by adding the following after subsection (4): (5) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (6) and (7) is transferred to the Minister of Jobs, Economy and Northern Development. (6) The responsibility for the administration of the unexpended balance of the portion of program 2.3, Technology and Innovation, related to economic policy and competitiveness and the film and tax credit program of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Jobs, Economy and Northern Development. (7) The responsibility for the administration of the unexpended balance of the portion of program 1.3, Strategic and Corporate Services, related to subsections (4) and (6) of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Jobs, Economy and Northern Development. 10 Section 15 is amended (a) by repealing subsection (1)(b), (k), (s), (z), (aaa), (hhh), (mmm), (uuu), (eeee), (oooo) and (pppp); (b) in subsection (2) (i) by repealing clause (a); (ii) by adding the following before clause (b): (a.1) Expropriation Act, except sections 27, 28 and 72; (c) by adding the following after subsection (5): (6) The responsibility for that part of the public service associated with the part of the appropriation transferred under subsection (7) is transferred to the Minister of Justice. (7) The responsibility for the administration of the unexpended balance of the portion of program 7, Public Security, related to the Alberta Chief Firearms Office of the 2022-23 Government appropriation for Public Safety and Emergency Services is transferred to the Minister of Justice. 11 Section 16 is amended (a) by repealing subsection (1)(b); (b) by adding the following after subsection (2): (2.1) The Minister of Mental Health and Addiction is declared to be the Minister responsible for the Mental Health Services Protection Act. (c) in subsection (4) (i) in clause (b) by striking out "[comma]"; (ii) in clause (c) by striking out "Licencing" and substituting "Licensing"; (iii) in clause (d) by striking out "Services" and substituting "Support"; (d) by adding the following after subsection (4): (5) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsection (6) is transferred to the Minister of Mental Health and Addiction. (6) The responsibility for the administration of the unexpended balance of the portion of program 8.3, Community-Based Health Services and program 8.6, Children's Health Supports, related to mental health and addiction of the 2022-23 Government appropriation for Health is transferred to the Minister of Mental Health and Addiction. 12 Section 18 is amended (a) in subsection (1) (i) by adding "responsible" after "the Minister"; (ii) by adding the following after clause (a): (a.1) Civil Enforcement Act; (iii) by adding the following after clause (c): (c.1) Disclosure to Protect Against Domestic Violence (Clare's Law) Act; (iv) by repealing clauses (e) to (n) and substituting the following: (e) Emergency Management Act; (f) section 7(b) of the Emergency 911 Act; (g) section 19 of the Fisheries (Alberta) Act; (h) Gunshot and Stab Wound Mandatory Disclosure Act; (i) Peace Officer Act; (j) Police Act; (k) Protecting Survivors of Human Trafficking Act; (l) Safer Communities and Neighbourhoods Act; (m) Scrap Metal Dealers and Recyclers Identification Act; (n) Security Services and Investigators Act; (o) Victims of Crime and Public Safety Act, except section 10(c); (p) section 1.1 of the Wildlife Act; (q) Witness Security Act; (r) Youth Justice Act; (s) sections 2(1) and 3(1) of the Emergency 911 Levy Regulation (AR 18/2014). (b) by adding the following after subsection (1): (1.1) The Minister of Public Safety and Emergency Services is designated as having common responsibility with (a) the President of Treasury Board and Minister of Finance for the Emergency 911 Act, except sections 3, 7(b) and 12(d), and (b) the Minister of Health for section 10(c) of the Victims of Crime and Public Safety Act. (1.2) The Minister of Public Safety and Emergency Services is declared to be responsible for the Civil Forfeiture Act. (c) by adding the following after subsection (4): (5) The responsibility for that part of the public service associated with the part of the appropriation transferred under subsection (6) is transferred to the Minister of Public Safety and Emergency Services. (6) The responsibility for the administration of the unexpended balance of program 11, 2013 Alberta Flooding of the 2022-23 Government appropriation for Municipal Affairs is transferred to the Minister of Public Safety and Emergency Services. 13 Section 19 is amended (a) in subsection (1) (i) by adding the following after clause (a): (a.1) Adult Guardianship and Trusteeship Act; (ii) by adding the following after clause (b): (b.1) Alberta Housing Act; (iii) by adding the following after clause (g): (g.1) Minors' Property Act; (g.2) Personal Directives Act; (iv) by adding the following after clause (j): (j.1) Public Trustee Act; (b) in subsection (2) (i) in clause (b) by striking out "Minister of Advanced Education and the Minister of Jobs, Economy and Northern Development" and substituting "the Minister of Jobs, Economy and Northern Development and the Minister of Skilled Trades and Professions"; (ii) in clause (c) by striking out "the, Minister of Advanced Education, the Minister of Health and the Minister of Jobs, Economy and Northern Development" and substituting "the Minister of Health, the Minister of Jobs, Economy and Northern Development and the Minister of Skilled Trades and Professions"; (iii) in clause (f) by striking out "Minister of Advanced Education, the Minister of Health and the Minister of Jobs, Economy and Northern Development" and substituting "the Minister of Health, the Minister of Jobs, Economy and Northern Development and the Minister of Skilled Trades and Professions"; (c) in subsection (3) by striking out "subsections (4) and (5)" and substituting "subsections (4), (5) and (6)"; (d) by adding the following after subsection (6): (7) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (8) and (9) is transferred to the Minister of Seniors, Community and Social Services. (8) The responsibility for the administration of the unexpended balance of program 1.3, Strategic Corporate Services of the 2022-23 Government appropriation for Technology and Innovation is transferred to the Minister of Seniors, Community and Social Services. (9) The responsibility for the administration of the unexpended balance of the portion of program 4.2, Assistance to Alberta Social Housing Corporation, related to funding for seniors lodges and care facilities of the 2022-23 Government appropriation for Health is transferred to the Minister of Seniors, Community and Social Services. 14 Section 20(1) is amended (a) by repealing clause (b); (b) by adding the following after clause (l): (l.1) Daylight Saving Time Act; (c) by repealing clause (o); (d) by adding the following before clause (p): (o.1) An Act to End Predatory Lending; (e) by repealing clause (q) and substituting the following: (q) Freedom of Information and Protection of Privacy Act, except Part 2; (f) in clause (t) by striking out "sections 2, 3 and 14 of Schedule 11" and substituting "sections 2 and 3 of Schedule 11"; (g) by repealing clause (aa). 15 Section 21 is amended (a) by repealing subsection (1) and substituting the following: Skilled Trades and Professions 21(1) The Minister of Skilled Trades and Professions is designated as the Minister responsible for the following enactments: (a) Agrology Profession Act; (b) Architects Act; (c) Chartered Professional Accountants Act; (d) Consulting Engineers of Alberta Act; (e) Engineering and Geoscience Professions Act; (f) Fair Registration Practices Act; (g) Schedule 8 to the Government Organization Act; (h) Labour Mobility Act; (i) Land Agents Licensing Act; (j) Land Surveyors Act; (k) Professional and Occupational Associations Registration Act; (l) Regulated Forest Management Profession Act; (m) Skilled Trades and Apprenticeship Education Act; (n) Veterinary Profession Act. (b) in subsection (3)(b) by striking out "Foundational Learning and Supports" and substituting "Foundational Learning Supports". (c) by adding the following after subsection (3): (4) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (5) and (6) is transferred to the Minister of Skilled Trades and Professions. (5) The responsibility for the administration of the unexpended balance of the portion of program 2.4, Labour Attraction and Retention and program 2.5, Labour Qualifications and Mobility, related to professional legislation and governance of the 2022-23 Government appropriation for Jobs, Economy and Northern Development is transferred to the Minister of Skilled Trades and Professions. (6) The responsibility for the administration of the unexpended balance of the portion of program 2.5, Labour Qualifications and Mobility, related to labour mobility and the Fairness for Newcomers Office of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Skilled Trades and Professions. 16 Section 22 is amended (a) in subsection (1) by adding the following after clause (b): (c) Electronic Transactions Act; (d) Part 2 of the Freedom of Information and Protection of Privacy Act; (e) section 14 of Schedule 11 to the Government Organization Act; (f) Interactive Digital Media Tax Credit Act; (g) Personal Information Protection Act. (b) in subsection (4) by striking out "program 1, Ministry Support Services" and substituting "program 1.1, Minister's Office and program 1.2, Deputy Minister's Office"; (c) by adding the following after subsection (4): (5) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (6) to (12) is transferred to the Minister of Technology and Innovation. (6) The responsibility for the administration of the unexpended balance of program 3, Data, Information and Privacy Services, except for those portions related to access services or the Alberta King's Printer, of the 2022-23 Government appropriation for Service Alberta and Red Tape Reduction is transferred to the Minister of Technology and Innovation. (7) The responsibility for the administration of the unexpended balance of the portion of program 4.3, Business Services Systems, related to Enterprise Resource Planning systems of the 2022-23 Government appropriation for Service Alberta and Red Tape Reduction is transferred to the Minister of Technology and Innovation. (8) The responsibility for the administration of the unexpended balance of the portion of program 1.3, Corporate Services, related to subsections (3), (6) and (7) of the 2022-23 Government appropriation for Service Alberta and Red Tape Reduction is transferred to the Minister of Technology and Innovation. (9) The responsibility for the administration of the unexpended balance of program 2.4, Grant to Alberta Innovates Corporation and program 3.5, Grant to Alberta Enterprise Corporation of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Technology and Innovation. (10) The responsibility for the administration of the unexpended balance of the portion of program 2.2, Industry and Regional Development, related to innovation employment grants of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Technology and Innovation. (11) The responsibility for the administration of the unexpended balance of the portion of program 2.3, Technology and Innovation, except for those portions related to economic policy and competitiveness and the film and tax credit program, of the 2022-23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Technology and Innovation. (12) The responsibility for the administration of the unexpended balance of the portion of program 1.3, Strategic and Corporate Services and program 2.1, Program Delivery Support, related to subsections (9), (10) and (11) of the 2022- 23 Government appropriation for Trade, Immigration and Multiculturalism is transferred to the Minister of Technology and Innovation. 17 Section 23 is amended (a) in subsection (1) by adding the following after clause (a): (a.1) section 1 of Schedule 3 to the Government Organization Act; (b) in subsection (4)(a) by striking out ", program 2.5, Labour Qualifications and Mobility and program 2.6, Labour Market Programs," and substituting "and program 2.5, Labour Qualifications and Mobility,"; (c) by adding the following after subsection (4): (5) The responsibility for that part of the public service associated with the parts of the appropriation transferred under subsections (6) to (9) is transferred to the Minister of Trade, Immigration and Multiculturalism. (6) The responsibility for the administration of the unexpended balance of the portion of program 2.3, Policy and Labour Market Information, related to newcomer supports of the 2022-23 Government appropriation for Jobs, Economy and Northern Development is transferred to the Minister of Trade, Immigration and Multiculturalism. (7) The responsibility for the administration of the unexpended balance of program 3.1, Program Delivery Support of the 2022- 23 Government appropriation for Jobs, Economy and Northern Development is transferred to the Minister of Trade, Immigration and Multiculturalism. (8) The responsibility for the administration of the unexpended balance of the portion of program 3.2, International Relations and Trade, related to trade policy of the 2022-23 Government appropriation for Jobs, Economy and Northern Development is transferred to the Minister of Trade, Immigration and Multiculturalism. (9) The responsibility for the administration of the unexpended balance of the portion of program 3.3, Investment and Industry Relations, related to international economic policy and industry relations of the 2022-23 Government appropriation for Jobs, Economy and Northern Development is transferred to the Minister of Trade, Immigration and Multiculturalism. 18 Section 24(4) is amended by striking out "Corridors" and substituting "Corridors.". 19 Section 25(1) is amended (a) by adding the following after clause (l): (l.1) sections 3 and 12(d) of the Emergency 911 Act; (b) by repealing clause (hh); (c) by adding the following after clause (tt): (uu) Emergency 911 Levy Regulation (AR 18/2014), except sections 2(1) and 3(1).
