Prevention of Cruelty to Animals Act

Dairy Cattle Regulation

Definitions

1   In this regulation:

"Act" means the Prevention of Cruelty to Animals Act;

"dairy cattle" means the following:

(a) a bull that is

(i) aged 6 months or older, and

(ii) kept for the purpose of breeding with the cows referred to in paragraph (c);

(b) a calf of a cow referred to in paragraph (c), if the calf is aged less than 6 months old;

(c) a cow that is

(i) aged 6 months or older, and

(ii) kept for the purpose of producing milk for human consumption, whether or not the cow is lactating;

"dairy farming" means the keeping and use of dairy cattle, whether or not a certificate has been issued under the Milk Industry Act in respect of the farm at which the dairy cattle are kept and used.

Prescribed regulated activity

1.1   Dairy farming is prescribed as a regulated activity for the purposes of the Act.

Code sets out generally accepted practices

2   The requirements and recommended best practices contained in the Code of Practice for the Care and Handling of Dairy Cattle, as produced by the National Farm Animal Care Council and published in 2009, are recognized as reasonable and generally accepted practices of dairy farming for the purposes of section 24.02 (c) of the Act.
