SPECIFIED ENACTMENTS (JURISDICTION) AMENDMENT REGULATION

on February 28, 2024 pursuant to section 26 of the Responsible Energy Development
Act.
1 The Specified Enactments (Jurisdiction) Regulation
(AR 201/2013) is amended by this Regulation.
2 Section 7 is repealed and the following is substituted:
Additional officials under section 23 of the Act
7(1) For the purposes of section 23 of the Act,
(a) the Minister referred to in Part 8 of the Mines and Minerals
Act is an official in respect of the powers, duties and
functions of or references to the Minister set out in that
enactment,
(b) the Minister referred to in the Exploration Regulation
(AR 284/2006) is an official in respect of the powers, duties
and functions of or references to the Minister set out in that
enactment,
(c) the Minister referred to in section 4(1) of the Exploration
Dispute Resolution Regulation (AR 227/2003) is an official
in respect of the powers, duties and functions of or references
to the Minister set out in that enactment,
(d) the Minister referred to in the Metallic and Industrial
Minerals Exploration Regulation (AR 213/98) is an official
in respect of the powers, duties and functions of or references
to the Minister set out in that enactment, and
(e) a "relevant Department authority" referred to in the
Exploration Regulation (AR 284/2006) is an official in
respect of the powers, duties and functions of or references to
a relevant Department authority set out in that enactment.
(2) For the purposes of Parts 8 and 9 of the Metallic and Industrial
Minerals Exploration Regulation (AR 213/98), the Minister of
Energy and Minerals is an official in respect of the powers, duties
and functions of or references to that Minister set out in Parts 8 and 9
of that enactment.
3 Schedule 1 is amended by repealing section 1.
4 Schedule 2 is amended
(a) in section 1(g)
(i) in subclause (i) by striking out "2(c) to (j)" and
substituting "2(d), (e), (f) in respect of the
manufacture or processing of cement, (g) to (j)";
(ii) in subclause (ii) by striking out "(b) in respect of a
quarry,";
(b) in section 2
(i) by repealing clause (b);
(ii) in clause (i) by striking out ", (e)";
(c) in section 11
(i) in clause (a) by striking out "items (a) and (b)"
and substituting "item (a)";
(ii) by repealing clause (g) and substituting the
following:
(g) items (k), (l), (n), (o), (p), (r), (s), (t), (u) and (v)
listed in Schedule 1;
(g.1) item (w) listed in Schedule 1 in respect of a cement
plant;
(g.2) items (x), (y), (z) and (aa) listed in Schedule 1;
5 This Regulation comes into force on the coming into
force of Part 3 of the Mineral Resource Development Act.
