Under the Motor Vehicle Safety Act, Transport Canada regulates the safety performance of motor vehicles and equipment in Canada. The act requires that any company that imports or makes vehicles in one province and sells them in another province certifies that these new vehicles meet all applicable safety regulations and standards.

Transport Canada recently updated Canada Motor Vehicle Safety Standard 108. This change introduced new rules to allow advanced lighting technologies that will make it easier for drivers to see, without affecting the visibility of oncoming drivers.

We also updated another section related to the Regulations Amending Certain Regulations Made under the Motor Vehicle Safety Act (National Safety Marks and Importation, which will come into force in February 2021. This update renamed the prescribed class “restricted-use motorcycle” to “restricted-use vehicle” to better represent the types of vehicles included under the expanded definition of the prescribed class.

The definition of “restricted-use vehicle” was expanded to include all vehicles designed to travel with four wheels or less, and not designed for use on public roads. These vehicles with a maximum speed of 32 km/h or less are no longer considered as part of the prescribed class.

A few other small edits are also suggested to correct minor errors during the last amendment, like the removal of marking requirements for replaceable bulb headlight systems.

Technical Standard Document (TSD) 108, includes a reference to the old definition, as such, it needed an update in order to align with the coming into force date. The updated Technical Standard Document will be published on February 4, 2021.
