Explanatory note

General policy statement

The purpose of this Bill is to establish an annual public holiday to acknowledge Matariki. This Bill sets the dates for the Matariki public holiday from 2022 to 2052 and provides for future dates for the Matariki public holiday.

Establishing the Matariki public holiday reflects the Government’s commitment to recognising and celebrating an important aspect of te ao Māori. None of Aotearoa/New Zealand’s existing 11 public holidays explicitly recognise te ao Māori.

The Matariki Advisory Group (the Group) was appointed by Cabinet to provide advice on when and how the Matariki public holiday should be celebrated in a way that maintains the integrity of the Māori body of knowledge underpinning Matariki. The Group consisted of recognised experts who have deep knowledge and understanding of both te ao Māori and the body of knowledge associated with Matariki and the Māori lunar calendar. The Group advised that celebrations of the Matariki public holiday should focus on remembering those who have passed, celebrating the present, and looking forward to the future.

The whakataukī Matariki hunga nui (Matariki brings us together) has guided the decision-making for when the Matariki public holiday is celebrated. The Bill ensures that for the next 30 years the holiday will fall on the Friday adjacent to the weekend closest to the Tangaroa lunar phase (the point in the lunar month where the last quarter moon rises) of Pipiri (the Māori calendar period typically falling between June and July). This means the Matariki public holiday will create a long weekend and give people the chance to travel and spend time with whānau and friends.

The Matariki public holiday is intended to be an enduring celebration. The Bill includes an empowering provision to ensure that the Governor-General (on the recommendation of the Minister who is responsible for the administration of the Bill) can set the future dates for the Matariki public holiday by Order in Council.

The Ministry of Business, Innovation, and Employment is required to prepare a disclosure statement to assist with the scrutiny of this Bill. The disclosure statement provides access to information about the policy development of the Bill and identifies any significant or unusual legislative features of the Bill.

The Ministry of Business, Innovation, and Employment produced a regulatory impact statement on 8 June 2021 to help inform the main policy decisions taken by the Government relating to the contents of this Bill.

Clause by clause analysis

Provisions in English

Clause 1 is the Title clause.

Clause 2 provides that the Bill comes into force on the day after the date on which it receives the Royal assent.

Part 1Preliminary provisions

Clause 3 sets out a statement that explains the meaning and significance of Matariki to Māori.

Clause 4 provides that the Act binds the Crown.

Part 2Matariki public holiday

Clause 5 provides that there will be a public holiday each year to acknowledge Matariki (Matariki Observance Day). The public holiday will be observed on the dates set out in Schedule 1.

Clause 6 is a regulation-making power. It provides for subsequent dates to be added to the list of dates in Schedule 1 by Order in Council. It also provides that all future dates of Matariki Observance Day must be Fridays, and that future dates must be set at least 4 years in advance.

Clause 7 provides for making the consequential amendments that are set out in Schedules 2, 3, and 4. Schedule 2 adds Matariki Observance Day to the list of public holidays in the Holidays Act 2003. Schedules 3 and 4 add the new public holiday to existing lists of holidays in other primary and secondary legislation.

Matariki is the Māori name for Pleiades, an open star cluster within the constellation of Taurus. For many Māori, the eastern pre-dawn appearance of Matariki in the winter sky, during the last quarter of the lunar month of Pipiri, marks the beginning of the Māori New Year (also known as te mātahi o te tau). The rising of Matariki launched the most significant celebration in the traditional Māori calendar, and its appearance continues to be honoured today with ritual and ceremony. Matariki marks a period of reflection and remembrance, celebration and festivities, and focus on the promise of a new season. Matariki is part of an environmental calendar system that includes the position of the sun, heliacal rising of stars, lunar phases, and regional ecological events. All of these factors inform a Māori environmental-driven division of time.

Some tribal groups use the heliacal rising of other stars as their marker of the Māori New Year, in particular the star Puanga (Rigel). Other tribal groups and regions also have variations regarding when and how the Māori New Year is observed and celebrated.

Matariki is guided by the following 3 major principles:

  • remembrance: honouring those who have died since the last rising of Matariki:

  • celebrating the present: gathering together with family and friends:

  • looking to the future: looking forward to the promise of a new year.

Matariki is also underpinned by key values, most significantly—

  • aroha—love and respect for one another:

  • whakamaharatanga—remembrance:

  • kotahitanga—unity:

  • manaakitanga—caring:

  • tohatoha—sharing:

  • mana taiao—environmental awareness:

  • hākari—feasting:

  • wānanga—discussion:

  • noho tahi—coming together:

  • atawhaitanga—kindness:

  • whakanui—celebrations:

  • tuakiritanga—identity.

Matariki is a time to gather, to acknowledge those who have passed, to celebrate the present, and to plan for the future. Matariki is the star of the Māori New Year.

4 Act binds the Crown

This Act binds the Crown.

Part 2 Matariki public holiday

5 Observance of public holiday to acknowledge Matariki

To acknowledge Matariki, a public holiday is to be observed on each date specified in Schedule 1 (Te Rā Aro ki a Matariki/Matariki Observance Day).

6 Regulations

(1)

The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations adding to Schedule 1 a date in a year on which the public holiday will be observed to acknowledge Matariki in that year.

(2)

The Order in Council must, for each public holiday, specify a date—

(a)

that is a Friday; and

(b)

that is in a calendar year following the last date in Schedule 1.

(3)

The Order in Council must be made at least 4 years before the last date in Schedule 1.

(4)

Regulations made under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

7 Consequential amendments

Amend the legislation specified in Schedules 2, 3, and 4 as set out in those schedules.
